There are many online platforms that ‘rank’ multiple offers in order of price offered – highest offer at the top etc. Each state has different laws in this regard and this information refers to Western Australia only.

While this ranking process may be alright in an auction situation whether online or live, it certainly falls into a grey area. That’s because giving an offer a position can, in a de-facto sense, indirectly disclose the amount of the offer that is being displaced.

Any property that is being offered in an environment where a buyers offer is ‘ranked’ or disclosed to other buyers, the buyer should provide written consent to that process being used.
